2. Subject of the Contract

The subject of this contract is to determine the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 4077 and the Regulation on the Application Principles and Procedures of Distance Contracts, regarding the sale and delivery of the product specified below, which the BUYER has ordered electronically from the website http://www.sarahlens.com owned by the SELLER.

3. Rights and Obligations

a) Necessary measures for the security of the information entered by the User to www.sarahlens.com have been taken by www.sarahlens.com and/or relevant Card Institutions depending on the nature of the information and transaction in the system and internet infrastructure. All credit card transactions and approvals are carried out directly online between the User and the relevant Bank and similar Card Institutions. (Information is not visible or recorded by www.sarahlens.com)

b) www.sarahlens.com keeps confidential the membership, product/service purchase, and credit card and bank card information of the User and cannot share it with third parties or organizations.

c) The right to use the password used by the User when entering www.sarahlens.com belongs exclusively to the User. It cannot be shared with third parties or organizations. Therefore, www.sarahlens.com reserves the right to claim any compensation and other claims arising from unauthorized use against www.sarahlens.com.

d) It is the responsibility of the User to store or back up the messages sent to www.sarahlens.com. www.sarahlens.com cannot be held responsible for the loss, deletion, or damage of messages.

e) The User, who is a member of www.sarahlens.com, accepts and declares that he/she allows the presentation of product and service promotions, advertisements, campaigns, advantages, surveys, and other User satisfaction applications to him/her, unless otherwise notified, within the framework of the legal obligations by www.sarahlens.com, such as e-mail, SMS, etc.

f) The User agrees and declares that he/she will not claim any direct and/or indirect material and/or moral negative and/or positive, in short, any damage due to the collection, sharing, use, archiving, and access of the above-mentioned information. If the User wants to change his/her data sharing preferences, he/she can use the "unsubscribe" link in all e-mails sent by www.sarahlens.com or can convey this request to www.sarahlens.com Customer Services. The User whose membership is terminated loses the right to log in to the site. The User accepts that this process is irreversible.

g) The decision to delete all kinds of records related to the user account terminated by the user at www.sarahlens.com belongs to Labella Lens. The User cannot claim any rights or compensation regarding the deleted records.

h) www.sarahlens.com may disclose the personal information of the User when requested by legal authorities, if it deems it necessary to comply with legal requirements, and/or to protect and defend the rights and property of Labella Lens in cases where it believes in good faith that it is necessary.

i) www.sarahlens.com reserves the right to change the content of the site at any time, change any service provided to users, or terminate them, or delete user information and data registered on www.sarahlens.com. Each modified, updated, or repealed provision will be effective for all members as of the publication date.

j) If the User does not comply with the obligations specified in this contract or the usage conditions notified in www.sarahlens.com, the User's membership on www.sarahlens.com may be canceled or blocked.

k) The User can start using www.sarahlens.com by filling in the required sections for registration and confirming his/her e-mail address.

4. Right of Withdrawal and Return for the Buyer

The buyer has the right to withdraw from the contract within 7 days from the delivery of the product to himself/herself or the person/organization at the address he/she specified. The use of the right of withdrawal is subject to the condition that the BUYER notifies the SELLER by fax, email, or telephone within this period and the product is not used within the framework of the provisions of Article 5. In case of using this right, the original invoice and a copy of the cargo delivery report indicating that the product has been sent to the SELLER must be sent. The product price is refunded to the BUYER within 7 days following the arrival of these documents. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded. The shipping cost of the product returned due to the right of withdrawal is covered by the BUYER.

5. Products for Which the Right of Withdrawal and Return Cannot Be Used

The use of the right of withdrawal is subject to the condition that the package of the product has not been opened, the product has not been used, and the expiration date of the product is not close.

6. Exchange and Inspection

Conditions for Exchange: The product to be sent for exchange must have been opened a maximum of 2 times for customer satisfaction in transparent lenses and must not be deformed from the box; unopened and undeformed lenses are required. Exchange transactions are not performed for opened and deformed lenses.

Inspection conditions: The product to be sent for inspection can be requested to be sent for inspection by contacting the customer support unit within one week after its delivery to you. The inspection period varies between 1 week and 90 days, determined by the Turkey Distributors of the companies. The result of the inspection is communicated to you with a report sent by the companies. The shipping costs during the inspection and exchange period belong to the final consumer.

7. Warranty, Return, and Cancellation Product Guarantee

All products we sell are under the manufacturer's warranty against manufacturing and similar defects.

Return Conditions: As stated in the Consumer Protection Law No. 4077, if the purchased products are not opened, not deformed, and the entire cargo content (including promotional and gift products) is sent intact, they can be returned within 15 days of sale, and the amount paid is refunded.

Order Cancellation; It is sufficient to inform our customer services by phone or e-mail for the cancellation request of orders whose payment has been approved and has not been delivered to the cargo. Your order and payment will be canceled as soon as possible, and the payment made will be refunded to your credit card/bank account. The return of orders whose payment has been received and delivered to the cargo is refunded by deducting the round-trip shipping fee and VAT.

8. Authorized Court

In the application of this contract, Consumer Arbitration Boards declared by the Ministry of Industry and Trade up to the value specified, and Consumer Courts in the settlement of the SELLER are authorized.

Return Conditions; As stated in the Consumer Protection Law No. 4077, if the purchased products are unopened, undeformed and all cargo contents (including promotional and gift products) are sent completely, they will be returned within 15 days from the date of sale and the price will be paid.

 

Order cancellation ; All you have to do is send your cancellation request for orders that have received payment confirmation and have not been delivered to cargo to our customer services by phone or e-mail. Your order and payment will be canceled as soon as possible and the payment will be refunded to your credit card/bank account. Your orders, which have been paid and delivered to the cargo, will be refunded with the arrival and departure shipping fee and VAT deducted.

Delivery and Return

Delivery Terms:
· Your orders are delivered to contracted cargo companies; It is delivered to you by Yurtiçi Cargo and Aras Cargo.
· Your orders placed with free shipping service can be sent with a different cargo company than your choice in cases of necessity (congestion in cargo companies, closure of cargo branches, etc.). · For cash on delivery orders, the cargo transportation fee is still covered by us, but a collection commission of 25.00 TL is taken by the cargo. · For orders with TRNC and International recipient addresses, the shipping fee is paid by the buyer. · Taxes and duties that may occur on your orders with TRNC and International recipient addresses are covered by the buyer. · Due to the shipping rules, solution delivery cannot be made for your orders placed from TRNC and abroad. · Your cargo is sent on behalf of the member unless you specify otherwise. If you are not at the address, it can be delivered to your first degree relatives upon presentation of your ID. Other deliveries are at the discretion of the cargo companies. · If you cannot be at the address during cargo delivery, your cargo is generally kept at the delivery branch for 3 business days. Cargoes that are not received within this period will be sent back to us. Shipping costs of orders delivered for the second time are covered by the buyer. · When receiving your cargo, check it with the cargo officer and receive it.
· Your orders placed between 16:30 on weekdays and 12:00 on weekends will be delivered to the cargo on the same day (if all your products are in stock). Your orders placed after the above hours will be shipped on the next business day. If one or more of the products in your order are not in stock and the delivery time is more than 2 business days, our customer representatives will contact you. · Delivery times for your cargo are determined by cargo companies. Delivery is generally made within 1 business day in Istanbul and nearby provinces, and within 2 business days in remote areas. These times may vary due to weather conditions, cargo company density and similar reasons. Deliveries may be limited in places where there is no cargo branch. · Cargo is not shipped on public holidays.
